Safeguarding your information
is important to us. NanoSnap, LLC ("NanoSnap") has implemented the following technologies
and procedures outlined in this document to keep your personal and financial information
safe.
With regards to the
processes we have in place to safeguard your information, please note that we make
a distinction between Personal Information, Financial Information and Non-Personal
Information. Personal Information includes any non-financial information that we
may explicitly collect from you, including your name, address, email address, or
information about the party to whom you want your order shipped, etc. Financial
Information includes only your credit and/or debit card number, expiration date,
and CVV2 code (the three or four digit security code on your card). Non-Personal
Information is any non-personally identifiable information collected about your
usage of NanoSnap’s website(s) and Services, such as your IP addresses, operating
system, computer configuration, pages visited, time each page is viewed, etc.
Financial Information
Policies
When you submit sensitive
Financial Information to us, the submission from your computer to our servers is
protected via industry-standard secure socket layer (SSL) technology which encrypts
that data as it travels to our servers. Once your Financial Information arrives
at our servers and is decrypted, we must share that information with selected third-parties
necessary to the completion of your order (for example, a Payment Gateway provider
who will complete the credit card transaction). Please note that although we encrypt
this information in transit to these third parties via SSL, these third-party providers
maintain their own sets of procedures and policies related to the handling of your
Financial Information. Since NanoSnap has no control over these third parties, we
cannot be held responsible for their policies, procedures, or handling of your Financial
Information.
NanoSnap does not intentionally
store your Financial Information in permanent form. Once we receive your Financial
Information, we immediately transfer it to a third-party Payment Gateway provider
(and/or bank, etc.) and actively attempt to routinely delete your Financial Information
from our servers. Although we do not store your Financial Information, NanoSnap
is typically provided with a unique identifier (e.g., transaction or reference ID)
from these third-party providers which documents a payment attempt and enables us
to apply (either automatically or manually, through our software or the third party's
software) further transactions against your payment method for the purposes of adjusting
totals, refunding money, resubmitting a payment request, denying transactions for
suspected fraudulence, etc. Please note that NanoSnap may permanently store these
transaction ID values for such purposes and may share them with third-parties when
we deem it necessary to successfully complete these types of activities.
Personal Information
Policies
When you submit Personal
Information to us, NanoSnap permanently stores this information in unencrypted form
in its servers and databases, and in its backups, regardless of whether this information
is transmitted to NanoSnap in encrypted form via SSL technology. This may include
any non-financial information such as your name, address, email address, order history,
etc.
As an example, your
Personal Information is transmitted to NanoSnap via SSL as part of the order checkout
process. SSL secures only the actual transmission of the data from your computer
to our server(s). Once your Personal Information reaches NanoSnap’s servers, it
is decrypted and stored in unencrypted form for use in the checkout process. NanoSnap
has, however, taken technical precautions to prevent an attacker from gaining your
Personal Information and Financial Information simultaneously, such as not permanently
storing any Financial Information you provide to us.
Please note that any
personally identifiable information transmitted to NanoSnap in the process of customizing
an item (for instance, providing your name and address to be printed on party invitations)
is typically transmitted and stored in unencrypted form and is also considered Content,
which has separate and/or additional policies that apply to it (see below, “Transmission
of Content & Customization Information”).
With regard to Personal
Information that you submit, we may share this information with third party vendors
who play a part in the order process (for instance, shipping carriers or printing
providers). When we are only transmitting Personal Information to these providers
(for instance, to create a shipping label for your package, or to print party invitations
that bear your name and address), then we may or may not transmit this information
in encrypted form at our discretion.
We will not, however,
provide your Personal Information to third parties who are not part of the order
process, except as part of a Fundraising Program (see “Special Note on Fundraising
Programs” below).
In any case, we may
use the Personal Information that you provide to us in the course of business: to
document, process and fulfill orders that you submit to us; to respond to customer
service requests; and to provide a personalized shopping experience tailored to
your preferences and order history, although this list is not exhaustive.
Additionally, we may
use the Personal Information you submit to us to contact you in a marketing or promotional
capacity. By submitting a billing or shipping address to us, you agree that we may
send marketing materials to the physical or PO Box address you provide. We will,
however, send marketing materials to any email address you provide only if you choose
to opt-in to our promotional email list. If you choose to opt-in to our promotional
email list, we may also send marketing and promotional emails on behalf of third
parties we select. If you choose to opt-out of our promotional email list, we may
still contact you for non-promotional purposes in reference to current or past transactions.
We will not sell your
Personal Information to any third party, unless our company merges with or is acquired
by another company. Under such circumstances, an acquiring company will have to
comply with our Privacy Policy in its current form at the time of purchase. However,
it should be clearly understood that once another company has acquired NanoSnap,
the acquiring company may modify, alter, or discard this Privacy Policy at its discretion.
Additionally, if NanoSnap acquires another company or companies, you acknowledge
that NanoSnap may share your Personal Information with the company or companies
that it acquires.
Special Note on Fundraising
Programs
NanoSnap offers a special
Fundraising Program whereby organizations can sign up with us to encourage traffic
to our site and receive a portion of the profits from those sales they direct to
us. If you are visiting our site through a Fundraising Program participant, this
fact will be made clear to you as you are using the NanoSnap site. In this scenario,
we may share your Personal Information with the organization which is running the
Fundraising Program with us, even though this organization is not directly participating
in the manufacturing or processing of your order or products. We may also share
Non-Personal Information collected from or about you (as described in the next section)
with these organizations. We will not share your Financial Information with this
third-party organization, nor will we will provide them with the Transaction ID
that results from your submission of your Financial Information.
Additionally, when purchasing through a Fundraising Program participant, you may
have the opportunity to join a publicly viewable list of contributors whose purchases
have also benefitted the Fundraising Program participant. If you join this list,
you acknowledge that portions of your Personal or Non-Personal Information, including
but not limited to your name and purchasing history, will become publicly available
information (e.g., NanoSnap must display your name to anyone who visits and views
this list). Additionally, you understand that this information will not only become
publicly available to visitors of NanoSnap but also to a worldwide audience, since
NanoSnap has no control over third parties who may access or collect this information
from us
(e.g., third party search engines may cache this information). Consequently, you agree that NanoSnap
will bear no responsibility for the manner in which this information is used (e.g.,
by third parties). You may request, however, that NanoSnap remove your name from
the contributors list even after you have placed an order by emailing support@nanosnap.com,
understanding that such removal will only remove you from the list as it appears
when delivered to end-users' computers directly from NanoSnap's servers.
Non-Personal Information
Non-Personal Information
is typically automatically collected as part of your usage of our website. In order
to function properly, NanoSnap requires that you allow us to store "cookies" on
your computer. Cookies are files stored on your computer used for tracking, login,
state management and other purposes and are supported by major internet browsers
such as Internet Explorer, Firefox, etc. Disabling cookies may prevent you from
using NanoSnap's website or services, or from purchasing from us.
Additionally, NanoSnap
contracts with third-party vendor(s) to collect both statistical and aggregated
usage information about the site (i.e., how many visitors came to the site on a
certain day, what pages they viewed, how long they viewed them, what pages they
left on, what IP addresses they visited from, etc.). We do not provide these vendor(s)
with the Personal Information that you submit to us. Among other uses, we may use
the statistical information that these providers gather, however, for our own marketing
purposes, to improve our site, to analyze traffic patterns to our site, or to provide
statistical or aggregated statistical information to third parties interested in
advertising on our site.
In addition to collecting
purely statistical information through these third-party vendor(s), NanoSnap also
internally tracks usage of its site(s). We may link Personal or Financial Information,
order information, customization options, or Content (see below) that you provide
to your Non-Personal Information. For instance, we may record the IP address from
which Content is submitted to us, submit your IP address in tandem with your Personal
Information and Financial Information to our Payment Gateway provider, etc. Please
note that we will only share such correlated information which may personally identify
you (for instance, by IP address) with third-parties involved in the order process.
An exception to this policy is made when you purchase from us through an organization
running a Fundraising Program, in which case we may share such correlated information
with that organization too.
Although we will not
sell or share your correlated information with third parties outside of the order
process or Fundraising Program, please note that we reserve the right to translate
or transform any correlated information we collect into statistical information
about our visitors' usage of the site that does not identify you personally and
may share such information with third parties not involved with the order process
for purposes of marketing, advertising, etc. An example of such a transformation
of this information would be providing potential third-party advertisers with statistics
on how many photographs were uploaded from New Jersey (determined by comparing submitted
Content to the IP addresses the Content was submitted from) without providing them
with the IP addresses that we used to generate this information.
Technical Safeguards
NanoSnap actively tries
to safeguard the information you give us, and takes technical precautions to do
so, such as the use of SSL to encrypt information according to the guidelines above.
However, the industry-standard security technology we employ is not 100% secure,
the usage of our service is provided AS-IS with no warranty, and there is always
risk to submitting your Personal or Financial Information online. You must submit
this information to us at your own risk, and we cannot be held responsible for the
information you send to us or the security of it.
Account Security
When signing up to
use NanoSnap’s Services, you must create an account with us. This account will link
the email address you provide us to the information we collect about and from you
as outlined in this Privacy Policy.
As part of creating
this account, you will be asked for a password. It is solely your responsibility
to choose a password of sufficient complexity (containing uppercase and lowercase
letters, numbers, and special symbols) to thwart attackers. You are prohibited from
sharing your password or account with others, since the creation of your account
is an acceptance of this Privacy Policy and NanoSnap’s Terms of Service.
NanoSnap has taken
technical precautions to safeguard the password you choose; however, once again,
no technology is 100% secure. For this reason, we strongly recommend that you choose
a unique password for NanoSnap’s website(s) and Services, so that if your account
or password is compromised, your activities at other websites will not be compromised
as well. NanoSnap does not and cannot guarantee the safety of your account or any
password you choose, and you should act accordingly.
Transmission of Content
& Customization Information
Please note that policies
governing our use of Personal, Financial and Non-Personal Information contained
in this document do not apply to Content (electronic media files, photographs, text
that you would like to appear on products, etc.) that you submit to us, customization
information (e.g., the type of product) that you provide, order information, etc.
(collectively referred to as "Customization Information"), or to the manner in which
you submit or transmit this information. All Content or Customization Information
that you submit or transmit should be treated as information or data that any person
may view at any given time. All Content or Customization Information that you submit
to us through our website is typically stored unencrypted, sent unencrypted, transmitted
to third-party vendors and contractors without safeguards, and is viewed by our
employees and third-party vendors and contractors. Even on pages that are protected
by SSL, the transmission of Content or Customization Information may not be protected,
so the presence of SSL should not be misconstrued to be a means of protecting Content
or Customization Information that you submit. Please note that all Content or Customization
Information you submit may be stored permanently in our servers, systems and backups.
Once Content or Customization Information is submitted, NanoSnap is under no obligation
to remove Content or Customization Information from our systems. Note the type of
Content you may submit is governed by NanoSnap's Terms of Service (located at http://www.nanosnap.com/terms.aspx)
and you should read these Terms of Service since your use of NanoSnap's services
constitutes your agreement with the Terms of Service as well as this Privacy Policy.
Note on Acquisition
In the event of a merger
with or the acquisition of NanoSnap by another company, the information that NanoSnap
collects (as described in the policies above) may become the property of the acquiring
company or entity designated in a merger. As part of the terms of any such acquisition
or merger, NanoSnap will require that an acquiring company comply with this Privacy
Policy in its current form at the time of purchase; subject, however, to any changes
that the acquiring company or designated entity may make thereafter. It should be
clearly understood that once another company has acquired NanoSnap, the acquiring
company may modify, alter, or discard this Privacy Policy at its discretion. Additionally,
if NanoSnap acquires another company or companies, you acknowledge that NanoSnap
may share the information it collects as defined by this Privacy Policy with the
company or companies that it acquires.
Policy on Children
NanoSnap does not knowingly
sell, seek to sell, provide services to, or advertise or cater to children under
the age of 13. Children under the age of 13 are asked to not use the services on
our site. NanoSnap's site and services are intended for adults 18 and older. If
you are under 18, but at least 13 years old, you may use our site with the consent
of a parent or guardian who must agree to this privacy policy and to the Terms outlined
in our Terms of Service (http://www.nanosnap.com/terms.aspx).
Law Enforcement
In direct contravention
of all the policies stated above, in the event that we receive an official request
from law enforcement or public officials, we may choose to share your Personal,
Financial, or Non-Personal Information with the officers or agencies seeking such
information if we deem it appropriate or are required by law.
Additionally, you should
be aware that we may be required to report Content or any Personal, Financial, or
Non-Personal Information that violates applicable U.S. laws or regulations and may
pre-emptively and proactively report any such data to the appropriate authorities,
which violates, or that NanoSnap believes may violate, such laws or regulations.
